Mindful Budget Service Agreement Terms and Conditions
Introduction
This Service Agreement ("Agreement") outlines the terms and conditions governing the use of the Mindful Budget digital products, courses and services ("digital products, courses and services") provided by Mindful Budget ("Provider"), and the responsibilities of the participants and customers ("Participants"). By enrolling or purchasing the digital products, courses and services, Participants agree to abide by these terms.
General Nature of Information
All information provided across the digital products, courses and services and services are of a general nature and is intended for educational purposes focused on financial management, budgeting, investing, and superannuation. The Provider does not provide personal financial, taxation, investing, or superannuation advice.
Financial Advice Disclaimer
Participants are reminded that the information presented in the digital products, courses and services does not constitute personal financial advice. Any financial decisions made based on the information provided are at the sole discretion of the Participant. It is recommended that Participants seek advice from qualified professionals for personalised financial guidance.
Taxation Disclaimer
The information contained in the digital products, courses and services does not take into account individual circumstances or taxation situations. Participants are advised to consult the Australian Taxation Office (ATO) or a certified accountant before implementing any taxation-related actions based on the digital products, courses and services content.
Investment and Superannuation Disclaimer
Participants considering investment or superannuation decisions should consult a qualified financial advisor before proceeding. The digital products, courses and services do not provide specific investment recommendations or personalised superannuation advice.
Accuracy of Information
All information presented in the digital products, courses and services is accurate and true to the best of our knowledge at the time of production. However, Participants are advised that market conditions and financial products can change over time, and the accuracy of information may vary accordingly.
Variations
We reserve the right to vary digital products, courses and services at our discretion. Variations may include moving to a new platform, amending digital products, courses and services material, or making other improvements. No refund or credit is provided for such variations.
Payment Terms
Products and services from the Mindful Budget digital products, courses and services may be purchased online and are available to both members and the general public. Purchases can be made through a third-party ticketing platform (e.g., Kajabi) and may be subject to the terms and conditions of that platform. To gain access to the digital products, courses and services, you must pay the specified price ("Price") and any associated credit card surcharges or administration fees as outlined on our website and per the Payment Terms.
Fees and Payments
You are obligated to pay the total amount of the digital products, courses and services fees, even if you do not complete the digital products, courses and services. Prices may be subject to change, and reasonable efforts will be made to inform you of any changes. Access to the products is granted upon receipt of full payment of the fee or, for payment plans or membership/subscription products, upon receipt of the first instalment of the selected payment plan.
Due to the nature of online payments, your payment might appear as "pending" for several days. While we grant immediate access upon payment, if the payment subsequently fails, access may be revoked without prior notice.
Payment Authorisation
By making an online payment with your credit or debit card, you authorise us to automatically charge your payment method for the specified amounts. You also give us permission to share your payment information with third-party payment providers to complete the transaction (e.g Stripe).
For payment plans or subscription-based products requiring recurring payments: a) You authorise us to charge your payment method automatically for each subsequent payment. b) You are responsible for ensuring that your payment method remains valid for the duration of the payment plan or subscription. If your payment method becomes invalid, you must notify us before the next payment is due. c) You understand that you are required by law to complete all remaining payments unless a valid refund request has been made and verified.
Consequences of Failed Payments
If a payment fails or is not made by the due date, your access to the digital products, courses and services and related materials will be suspended. Restoration of access requires payment of the total remaining balance, regardless of the number of remaining instalments.
We reserve the right to charge an additional fee for dealing with repeated failed payments. This fee of $25 compensates for administrative burdens related to failed payments.
Refunds
Due to the nature of digital products, refunds are not provided for change of mind. However, refunds or remedies under the Australian Consumer Law (ACL) may be considered if:
- a) You encounter technical issues that prevent access, and you notify us with proof of purchase and provide evidence of technical issues to [email protected].
- b) Mindful Budget cannot deliver digital products, courses and services you have paid for.
A 7-day "Show Your Work" refund policy is offered. If you're dissatisfied and meet certain conditions, you can request a refund within 7 days of purchase, with an admin and termination fee of $50 deducted. You need to provide proof of purchase and proof of willingness to comply with the requirements of the course, product or service including completing action steps and worksheets to
Limitation of Liability
The Provider, its employees, including Raegan Hanks, Chris Rule and Mindful Budget hold no responsibility for any actions or decisions made by Participants based on the digital products, courses and services content. Participants assume full responsibility for the outcomes of their financial, taxation, investment, and superannuation decisions. The Provider is not responsible for any loss of income or financial consequences resulting from participating in the digital products, courses and services.
By accessing digital products, courses and services, you acknowledge that no guaranteed outcomes are associated with digital products, courses and services results, including improvements in financial literacy or investments. The purpose of the digital products, courses and services is for education and information purposes only.
This Agreement represents the understanding between you and Mindful Budget regarding the digital products, courses and services and supersedes any prior agreements or understandings. You acknowledge that these terms are fair and reasonable in the context of digital education and services.
Role of Raegan Hanks and Chris Rule
Raegan Hanks and Chris Rule are financial coaches and budget planners. They are not a financial counsellors, therapists, or advisors. The purpose of the digital products, courses and services is strictly for educational purposes. Participants are advised to seek assistance from qualified finance professionals, counsellors, or advisors before acting on any information provided in the digital products, courses and services.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Provider is based (Australia).
By enrolling or purchasing in any Mindful Budget digital products, courses and services, Participants acknowledge that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
